There is an obvious solution to the Government’s problem over the asylum-seeker hotels. Whether it would be politically wise is another matter.
Since the injunction was (in part) based on the need for planning permission for a change of use from hotel to hostel, the Government could amend the Town and Country Planning (General Permitted Development) Order to remove the need for permission. This can be done under secondary legislation, and the Government’s large Parliamentary majority can be used to overcome any opposition.
Alternatively, the hotel’s owner could be invited to apply for planning permission and, if this is refused by the local council, appeal to the Secretary of State, who could then allow the appeal and grant permission. Provided that the Secretary only takes into account relevant planning considerations and disregards irrelevant matters, this should be immune to judicial review.
I can't believe that the Government hasn't thought of this. It could of course have unforeseen consequences The fact that it hasn't been mentioned publicly suggests that the Government is afraid of the political consequences of appearing to flout public opinion.
